Terms and Conditions
1. General
These Terms and Conditions apply to the supply of custom-branded still and sparkling water in cans ("Products") by Can My Water (Aqualove Water Pty Ltd) ("Can My Water", "we", "us", "our") to the client ("you", "your"). By placing an order with us, you agree to be bound by these terms.
2. Products & Artwork
All Products are canned and packed at our facility in Pemulway, Sydney Australia using natural still or sparkling water.
Branding is created either by Can My Water based on your brief or supplied by you using our provided design template.
All artwork must be approved in writing (email is acceptable) before production commences.
3. Production & Lead Time
Lead time is approximately 6–10 weeks from the date of final artwork approval and deposit payment. Timelines may vary depending on the order quantity and material availability.
We will communicate any changes or delays to the production timeline as soon as reasonably possible.
4. Payment Terms
A 50% deposit of the total invoice amount is required after artwork approval.
The remaining 50% is payable upon completion of the order and must be paid in full before goods are released for shipping.
Payments are to be made via bank transfer to the account provided on the invoice unless otherwise agreed in writing.
5. Freight & Delivery
Freight responsibility (including costs, insurance, and logistics) must be negotiated and agreed prior to order confirmation.
If Can My Water arranges freight, we will select a courier or freight provider at our discretion unless otherwise agreed.
All cans are hand-packed in cardboard boxes to minimise damage during transport. However, due to the nature of freight, Can My Water is not liable for any damage (e.g., dents, scratches) that occurs during shipping once the product has left our warehouse.
6. Packaging
Products are packaged in cardboard boxes, designed for bulk transit. Can My Water will ensure cans are undamaged at the time of dispatch.
Any claims for discrepancies in order quantity or packaging must be made within 5 business days of delivery.
7. Limitation of Liability
To the extent permitted by law, Can My Water is not liable for any indirect, incidental, special, or consequential losses or damages, including but not limited to loss of profits or brand reputation.
Our total liability in respect of any order is limited to the value of that order.
8. Cancellations & Refunds
Orders cannot be cancelled once printing has commenced.
Deposits are non-refundable once materials have been purchased or artwork has been finalized and printing has commenced.
9. Public Liability Insurance
Can My Water maintains current public liability insurance. A copy of our certificate of currency is available upon request.
10. Force Majeure
We are not responsible for delays or failure to deliver caused by events beyond our control, including but not limited to natural disasters, acts of war, supplier delays, or transport disruptions.
11. Marketing & Promotions
We reserve the right to photograph and video record the production of your order for use in marketing, promotional, or advertising materials unless specifically requested not to by you in writing prior to production.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of the courts of New South Wales.
